Partnering with an Affiliate is very important to us. We treat our Affiliates fairly with the respect they are due. The following Terms and Conditions for the Melinda Coss Affiliate Programme have been written with you in mind, as well as to protect our company’s good name.The agreement will remain until terminated by either party with immediate effect. Terms of Reference
The Agreement: The Affiliate Agreement between MC Global Ltd. and The Affiliate. The Affiliate: The company or entity entering into this Agreement with MC Global Ltd. The Purchaser: Client purchasing a Mentoring Programme from MC Global Ltd. via The Affiliate The Programme: The Mentoring Programme consultancy provided be MC Global Ltd.
1/. Payment
MC Global Ltd. will pay a commission of the net purchase price on any Referrals that result in acceptance and a Programme being purchased. It is The Affiliate’s choice whether to receive all of this commission or whether to apportion Benefit, as an incentive, onto The Purchaser of the Programme. Benefit is passed on by way of a discount on the purchase price and thus will be stated on the link to Melindacoss.com on The Affiliate’s website, newsletter and/or other communications. The Affiliate must state his intention with regards to commission prior to the activation of The Agreement. Commission will not be paid on subsequent Programmes purchased by the Purchaser.MC Global Ltd. will provide The Affiliate with a commission payable schedule and will advise receipt of funds from The Purchaser and release of commission to The Affiliate. The Affiliate agrees to regularly reconcile his/her accounts to ensure that the commission paid is correct. MC Global Ltd. accepts no responsibility for any errors or omissions and their consequential implications, which are not notified to us in writing, or by email, within a reasonable period.While MC Global Ltd. will do everything we can to correct any errors or omissions that may occur, we will not be liable for any which are not promptly brought to our attention.i.) Payment terms for an Affiliate based in the UK:Payment will be made to The Affiliate once payment is received from The Purchaser, whether in instalments or in full, depending on payment terms agreed at the time of the purchase. If The Purchaser defaults or terminates The Programme at any time during The Programme, MC Global Ltd. will not be liable to pay commission on any subsequent instalment outstanding.ii.) Payment terms for an Affiliate based outside the UK:Payment will be made to The Affiliate once payment has been received in full from The Purchaser. If The Purchaser has agreed to pay in instalments at the time of purchase, commission will be paid to The Affiliate once the final payment has been received from The Purchaser. If The Purchaser defaults or terminates The Programme at any time during the Programme, MC Global Ltd. will not be liable to pay commission on any subsequent instalment outstanding.
2/. Termination
Either party may terminate this Agreement with immediate effect. Upon termination The Affiliate must remove all links to MelindaCoss.com and The Affiliate shall not be entitled to receive any commission on any referrals resulting in a purchase after the termination date. If MC Global Ltd. has effected the termination The Affiliate will continue to receive any commission due on outstanding payments by The Purchaser until completion of The Programme purchased.The Affiliate shall acquire no rights to use the Intellectual Property of MC Global Ltd. including domain names, published copy/text, images or any other works created by or for MC Global Ltd. following the termination of this Agreement.
3/. General
By entering into the Melinda Coss Affiliate Programme The Affiliate must provide bank account details where commission is to be paid. In the case of UK Affiliates full legal trading details, must be supplied. Affiliates based outside the UK, to whom we may pay regular or one off sums of money, may be asked to provide information in compliance with Money Laundering Regulations. Failure to comply will result in monies being withheld.Nothing in this Agreement shall create, or be deemed to create, a partnership or relationship of employer and employee between MC Global Ltd. and The Affiliate. The Affiliate is responsible for the payment of all tax and national insurance payable on any commission made to him/her by MC Global Ltd.. The Affiliate confirms to MC Global Ltd. that he/she is not a private individual less than 18 years of age. If you are under 18 years old and would like to become an affiliate, you must get a parent or guardian to contact us on your behalf.MC Global Ltd. shall not be liable for the legality of this Affiliate Programme in countries other than the United Kingdom. The Affiliate is solely responsible for the legality of the use of this Affiliate Programme if he/she is registered to this Programme from a country other than the United Kingdom, or if The Affiliate’s website is on a server in a country other than the United Kingdom.
4/. Copyright & Intellectual Property
MC Global Ltd. owns all copyrights, trademarks, intellectual property rights, know-how and/or any other rights connected to MelindaCoss.com. The Affiliate does not acquire any rights or licences whatsoever under this Agreement other than to use links to Melindacoss.com on the terms of this Agreement.The Affiliate consents to the publication of The Affiliate’s name and web address etc. on the Melindacoss.com website and to Melindacoss.com sending information to The Affiliate’s e-mail address and using the information given by The Affiliate for marketing purposes.
